What is the Public Service of Employment?
The Public Service of Employment is an initiative of the National Government that seeks to meet the labor supply and demand of the country in a transparent, agile and efficient manner.
It helps workers finding suitable jobs for their profile and employers to hire workers according to their needs, to increase the productivity and competitiveness of their companies.
Who are the users of the Public Service of Employment?

Job seekers who are unemployed or workers wishing to change their current work situation.

Employers are those who are looking for the human talent for the development of business activities.

Likewise, the Public Service of Employment offers prioritized specialized care to vulnerable populations.

How can I access the services offered by the Public Service of Employment?

Job Seekers: All workers who are interested in changing jobs or better opportunities can register their resume on the virtual service portal or service points across the country.

Employers and Vacancies: Entrepreneurs, who are looking for workers according to their needs, can register their vacancies on the service portal or in person at the attention centers in the country.

Job Seekers: Workers who come to the Employment Centers can receive guidance and analyze their competencies, skills and needs to facilitate their employment relationship.

Employers: The professionals of the Employment Centers accompany the entrepreneurs to understand their needs and subsequently publish their vacancy, so that it is easier and faster to find their workers.

In order to provide the vacancy, a selection of the potential candidates who meet the requirements requested by the employers is made.

Since when should all employers in the country report their vacancies to the Public Service of Employment?

From July 1st, 2014 until October 31st, the pedagogical implementation phase will be developed, while the measure is welcomed by the employers and known to the workers. During this period, they will work with them explaining the same, presenting the free human talent management services to which they are entitled, and the Employment Service Unit will follow up to evaluate the need to impose sanctions.

At that time, the National Government will regulate the possible sanctions for employers who do not report their vacancies to the Public Service of Employment.

What kind of employers are targeted by the measure?

All employers in the country are required to report their vacancies to the Public Service of Employment, choosing a Job Center through Attention Centers

What is the Government’s purpose in implementing this vacancy report?

The purpose of this measure is to guarantee the right to work that all Colombians have, allowing them to access the employment opportunities that exist in their city and in the country. Knowing the vacancies and job profiles demanded by companies allows better orientation of training for work and public education policies.

What benefits do the employers receive?

This measure allows companies to receive free advice in the creation and registration of vacancies and in the search of suitable personnel for their company, which was previously a costly and time-consuming process that can now be carried out with the support of specialists in Human talent that are found in the Employment Centers. These will provide employers with guidance, pre-selection and referral of human talent, which allows reducing costs and hiring times for the employer, increasing productivity and competitiveness by hiring the right staff as well as advice on other issues related to Management.

And the benefits for the workers?

The average unemployment period for Colombians is nine months. This measure will reduce the search times considerably.

What procedure must an employer or employer perform to register your business and its vacancies?

Employers must check their companies and their vacancies to an Authorized Service Provider can choose on the website Attention Centers and receive personalized attention. Once registered on the platform, the employer or entrepreneur will receive a username and password needed to post and track their vacancies. If you cannot approach an Authorized Service Provider, you can receive immediate attention in toll free 120 from any phone.

What law governs this measure?

Under enshrined in Article 31 of Law 1636 the Ministry of Labor by Decree 2852 of 2013, which establishes guidelines and regulates the procedure of registration of vacancies, the minimum content of the information to be recorded, and the duty of obligation providers of Public Service of Employment authorized to report this information to the System information of the Public Service of Employment and may be requested the exception of advertising vacancies in the Public Service of Employment.



What kind of jobs may be excluded from publication?

The vacancies are exempt from publication are those related to: strategic positions, special projects, management positions in specialized markets and industries. In any case, the vacancies exempting from publication must belong to positions of managerial or strategic level of the employer, unless publication represents risk to financial market stability or national security (paragraph 3 of Article 13 of Decree 2852, 2013 and Article 6 of Resolution 2605 of 2014).

Examples of vacancies that can be exempted from publication

Director and/or President; Vice president; Management of special projects implemented by the employing company.

Examples of vacancies that are not exempted from publication

Charges in operational and administrative level, such as professionals, technicians, operators. Charges with hierarchy within the company, but whose decisions are not across the entire company and do not affect the long-term objectives thereof, such as area coordinators, personnel managers, sales, production, etc.

How is the exception of publication of a vacancy requested?

The employer or the person in charge of human talent must do so at the time you make the registration of all vacancies to the employment service provider that you chose to manage them. At that time, the employer will request that they are not published in the Public Service of Employment, because of its substantial features, which involve the development of a strategic position itself, or holds a leading position in markets and specialized industries.

Where can I do this request?

In order to causing no trauma to the operation of the Public Service of Employment, i.e, delays in vacancy management, it was envisaged that the exception request publication be submitted to the lender, by a declaration made by the respective representative the employer, on the relationship of the vacancy with the characteristics described under the responsibility of the employer (Paragraph 3 of Article 13 of Decree 2852 of 2013 and Article 6 of Resolution 2605 of 2014).

And if you do not report the vacancies?

If selected by the employer for verification of compliance with its obligation and found that vacancies were unpublished, objectively, the Special Administrative Unit of the Public Service of Employment will officiate at the Directorate of Inspection, Monitoring, Control and Territorial Management Ministry of Labor, to forward the appropriate sanction administrative procedure.

What kind of jobs may be excluded from publication?

The rear control consists in requiring the employer to exhibit to this Unit a proof of the relation of the unpublished vacancy, with the features set forth in Decree 2852 of 2013. In this regard, it can be understood as evidence, for example, that the manual functions where the work carried out during the respective position is determined, the labor contract in which consist the obligations of the worker in carrying out its functions; form that allows confronting objectively if the vacancy published in the Public Service of Employment has the features of Paragraph 3 of Article 13.
